Injunction Sought on Anti-Gay Bill, Premature – Amanda Clinton


The apex court of Ghana, the Supreme Court has scheduled a ruling on the case regarding the Human Sexual Rights and Family Values Bill 2024.

Dr Amanda Odoi a researcher at the University of Cape Coast instituted a petition against the passage of the Proper Human Sexual and Family Values Bill 2024 requesting for an interlocutory injunction restraining Parliament from transmitting the controversial anti-gay bill to the President for assent or otherwise.

The bill seeks to impose criminal sanctions on the promotion of activities pertaining to lesbian, gay, bisexual, transgender, transexual, pansexual, or any other sexual orientation contrary to the sociocultural relationship between a male and a female.

Lawyer Amanda Clinton has said, “The injunction sought is premature.” She explains that Parliament has not completed its process by way of submitting the bill to the president.

She argues that upon completion of the process, a person based on Article 2(1) of the constitution can invoke the original jurisdiction of the Supreme Court.

“However, I think the Supreme Court will take the opportunity to state the implication the bill will have but I don’t think the Court will grant the injunction since it’s premature,” she said.
